I Was In An Accident While Driving My Friend’s Car.
Posted in Internal Engine Parts | Asked on Jul 31, 2011I was in an accident while driving my friend’s car. The car was totaled. He gave me permission to drive the car. While driving I was in slow moving traffic, so I switched lanes and while I was changing lanes the car in front of me stopped and I was unable to break fast enough. I feel very guilty of course. His insurance paid for nearly everything, except for his down payment which is a lot of money. Should I have to pay for his entire down payment or should I just pay some of it since he gave me permission. I asked him this and he said that I should pay everything. I argued that I was not driving carelessly, it was unfortunate that the car in front of me stopped. He said that I crossed a solid yellow line. I have checked the spot and I’m positive that I did not cross the solid line. He constitutes that this means I was driving carelessly. Since he gave me permission, does this put us both at fault. Should I pay the entire amount that hes out?
His car was covered except for the down payment he paid. That is the money he is out.

Yes you should
Down payment? You mean deductible? The highest it can be is $1,000. You need to pay it, YOU were driving whether or not you had permission. Your friend isn’t the one who didn’t brake in time, that was you. Don’t let this ruin your friendship.
Yes, you are responsible for the entire deductible or any money he’s out. If he sued you, he would win. When you drive anybody else’s car, you are responsible for any damage you cause regardless if you were driving carelessly or not. Just be thankful he had full coverage or it would have been a lot more you’ll have to pay. And besides, since you had an accident in his car, his insurance would probably go up because of this. So, pay the entire amount he’s out of pocket.
I’ve seen a lot of cases on Judge Judy like this and you won’t win if your friend sues you.
YOU are totally responsible for any and all monies owed to your friend since YOU had the accident.
It doesn’t matter he gave YOU permission – YOU took the car and the accident happened. YOU could have said “NO THANKS’.
You were driving and you were at fault. Your friend shouldn’t have to eat this expense. Pay him back his deductible. It’s the right thing to do.
